1. Service Description
Amantess ("Company", "we", "us", or "our") provides dedicated email infrastructure and B2B marketing campaign services. Our services include but are not limited to:
- Dedicated email server configuration and management
- PMTA (PowerMTA) setup and optimization
- B2B email campaign creation and execution
- Mailwizz platform integration and support
- Compliance consulting and monitoring
- Technical support and maintenance
2. Acceptance of Terms
By accessing and using our services, you ("Client", "you", or "your") agree to be bound by these Terms & Conditions. You must comply with all applicable email marketing laws including but not limited to:
- CAN-SPAM Act (United States)
- GDPR (European Union)
- CASL (Canada)
- Local and international data protection regulations
All email campaigns must have proper opt-in permissions and comply with applicable laws in the jurisdiction where recipients are located.
3. Client Responsibilities
As a client of our services, you are responsible for:
- Legal Compliance: Ensuring all email addresses are legally obtained with proper consent
- Content Accuracy: Providing truthful and non-deceptive email content and subject lines
- Opt-out Mechanisms: Including clear unsubscribe options in all campaigns
- Data Quality: Maintaining clean and updated email lists
- Response Handling: Processing unsubscribe requests within 10 business days
- Industry Standards: Following email marketing best practices and industry standards
4. Prohibited Activities
The following activities are strictly prohibited:
- Sending unsolicited emails (spam) to recipients without proper consent
- Using purchased, rented, or scraped email lists
- Sending emails with deceptive subject lines or false sender information
- Promoting illegal products, services, or activities
- Distributing malware, viruses, or harmful content
- Violating any applicable laws or regulations
- Attempting to compromise server security or infrastructure
5. Service Limitations and SLA
Service Level Agreement
- 99.9% uptime guarantee for server infrastructure
- 24/7 technical support for critical issues
- Response time: Within 4 hours for urgent matters
Limitations
We reserve the right to refuse service for campaigns that violate our policies. Email deliverability rates may vary based on campaign quality, recipient engagement, and external factors beyond our control.
6. Payment Terms
- Services are billed monthly in advance unless otherwise agreed
- Payment is due within 30 days of invoice date
- Late payments may result in service suspension
- Setup fees are non-refundable
- Price changes will be communicated 30 days in advance
7. Intellectual Property
All intellectual property rights in our services, software, and documentation remain with Amantess. Clients retain ownership of their data and email content but grant us necessary rights to provide services.
8. Data Protection and Privacy
We are committed to protecting your data in accordance with applicable data protection laws. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.
9. Termination
Either party may terminate services with 30 days written notice. We may terminate immediately for violation of these terms. Upon termination, you will have 30 days to retrieve your data before permanent deletion.
10. Limitation of Liability
Amantess shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from our services. Our maximum liability is limited to the fees paid for services in the 12 months preceding the claim.
11. Governing Law
These terms are governed by the laws of the jurisdiction where our primary business operations are located. Any disputes will be resolved through binding arbitration.
12. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective 30 days after notification. Continued use of services constitutes acceptance of modified terms.
